1. Overview

Covered America LLC ("Covered America," "we," "us," or "our") operates the website located at CoveredAmerica.org and related digital properties (collectively, the "Site"). Covered America is a licensed insurance agency providing advisory, comparison, and enrollment assistance services for health, dental, vision, life, and travel insurance products.

These Terms of Service and Privacy Policy (collectively, the "Agreement") govern your access to and use of the Site and any services we provide. By accessing the Site, submitting any form, or engaging with a licensed representative, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

⚠ If you do not agree to these terms, you must immediately discontinue use of this Site and its services. Your continued use constitutes acceptance of the most current version of this Agreement.

We reserve the right to update this Agreement at any time. Material changes will be indicated by a revised "Last Updated" date at the top of this page. It is your responsibility to review this Agreement periodically.

2. Terms of Service

2.1 Eligibility

You must be at least 18 years of age and a resident of the United States to use this Site. By using this Site, you represent and warrant that you meet these eligibility requirements.

2.2 Permitted Use

You may use this Site only for lawful purposes and in accordance with this Agreement. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, or local law or regulation;
  • Transmit any unsolicited or unauthorized advertising or promotional material;
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site;
  • Attempt to gain unauthorized access to any portion of the Site or any related systems or networks;
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose.

2.3 Not a Government Agency

Covered America LLC is NOT affiliated with, endorsed by, or connected to the U.S. Government, the Centers for Medicare & Medicaid Services (CMS), HealthCare.gov, Medicare.gov, or any federal or state agency. We are a privately-owned, licensed insurance agency.

2.4 No Guarantee of Coverage or Pricing

All plan information, premium estimates, subsidy calculations, and benefit summaries displayed on this Site are provided for informational and comparative purposes only. Final plan pricing, eligibility determinations, and enrollment confirmations are made exclusively by the applicable insurance carrier and/or the federal or state Marketplace. Covered America does not guarantee any specific premium, benefit, network, or enrollment outcome.

2.5 Accuracy of Information

We make reasonable efforts to ensure that information on this Site is accurate and current. However, insurance plan data, regulations, and subsidy rules change frequently. Covered America makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or suitability of any information on the Site.

2.6 Third-Party Links

The Site may contain links to third-party websites. These links are provided for your convenience only. Covered America has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

2.7 Intellectual Property

All content on this Site — including text, graphics, logos, icons, images, and software — is the property of Covered America LLC or its content suppliers and is protected by applicable United States and international intellectual property laws. Unauthorized use is strictly prohibited.

2.8 Termination

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including breach of this Agreement.

3. Privacy Policy

Covered America LLC is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our Site, request a quote, speak with an agent, or enroll in an insurance plan through our services.

This Privacy Policy is incorporated into and made part of our Terms of Service. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.

4. Information We Collect

4.1 Information You Provide Directly

We collect personal information that you voluntarily provide when you use the Site, request a quote, contact us, or enroll in services, including:

  • Identity Information: Full name, date of birth, gender;
  • Contact Information: Email address, phone number, mailing address;
  • Health & Demographic Information: Household size, ages of household members, tobacco use status, pregnancy status, disability status (as needed for plan comparison);
  • Financial Information: Household income, tax filing status (for subsidy/APTC eligibility calculations);
  • Insurance Information: Current coverage status, preferred plan type, prior carrier information;
  • Communications: Records of correspondence with our agents, call recordings (where legally permitted), and chat transcripts.

4.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically, including:

  • IP address, browser type and version, operating system;
  • Pages viewed, time spent on pages, links clicked, referring URLs;
  • Device identifiers and browser fingerprint data;
  • Cookie and tracking pixel data (see Section 7).

4.3 Information from Third Parties

We may receive information about you from third parties, including advertising partners, data brokers, public records, and insurance carriers, which we may combine with information we have collected about you.

📋 We do not collect Social Security Numbers, payment card numbers, or banking information through this Site. Enrollment payments are handled directly by insurance carriers.

6. How We Share Your Information

By submitting a quote request or enrollment inquiry, you expressly consent to Covered America sharing your personal and health-related information with licensed insurance carriers for the purpose of providing you with insurance quotes and enrollment services.

6.1 Insurance Carriers

We share your information with insurance carriers as necessary to generate quotes, facilitate enrollment, and service your policy. These carriers may contact you directly regarding your application or coverage.

6.3 Service Providers

We share information with trusted third-party vendors who assist us in operating our Site and business, including web hosting providers, CRM platforms, analytics services, email service providers, and call center technology providers. These vendors are contractually obligated to use your information only as directed by us and in accordance with this Policy.

6.4 Legal Requirements

We may disclose your information when required to do so by law, court order, or governmental authority, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

6.5 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. You will be notified of such a transfer and any material changes to this Privacy Policy.

6.6 We Do Not Sell or Share Your Personal Information

Covered America does not sell, rent, or share your personal information with third-party marketers, lead buyers, or data brokers. Your information is used exclusively to provide the insurance advisory and enrollment services you requested.

7. Cookies & Tracking Technologies

7.1 What We Use

We use cookies, web beacons, pixel tags, and similar tracking technologies to operate and improve the Site. These may include:

  • Essential Cookies: Required for the Site to function (session management, security);
  • Analytics Cookies: Including Google Analytics, which collects anonymized usage data to help us understand how visitors interact with the Site;
  • Marketing/Advertising Cookies: Used to deliver relevant advertisements and track campaign performance;
  • Remarketing Pixels: Including Meta Pixel and Google Ads tags, which allow us to serve targeted ads to prior Site visitors.

7.2 Google Analytics

We use Google Analytics to collect information about Site traffic and usage patterns. Google Analytics collects information anonymously and reports Site trends without identifying individual visitors. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

7.3 Your Choices

Most web browsers are set to accept cookies by default. You can set your browser to refuse all or some browser cookies or to alert you when websites set or access cookies. If you disable or refuse cookies, some parts of this Site may become inaccessible or not function properly. You may also opt out of interest-based advertising through the NAI Opt-Out Tool or DAA Opt-Out Tool.

8. SMS & Email Communications

8.1 Consent to Contact

By submitting your phone number or email address on this Site, you expressly consent to receive communications from Covered America LLC and its affiliated licensed agents and insurance carriers, including:

  • Telephone calls (including autodialed and pre-recorded calls);
  • SMS/text messages;
  • Email communications.

This consent is not a condition of purchasing any insurance product or service.

8.2 TCPA Compliance

All telemarketing, autodialed, and pre-recorded calls and text messages are made in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable FCC regulations. By providing your telephone number, you represent that you are the account holder or have the authority to provide consent on behalf of the account holder.

8.3 SMS Terms

Message and data rates may apply. Message frequency varies. To opt out of SMS communications at any time, reply STOP to any message we send you. For help, reply HELP or contact us at support@coveredamerica.org. Covered America is not liable for delays or failures in SMS delivery.

8.4 Email Opt-Out

To opt out of marketing emails, click the "Unsubscribe" link in any marketing email or contact us at support@coveredamerica.org. You may continue to receive transactional and service-related emails even after opting out of marketing communications.

8.5 Do Not Call Registry

By providing your telephone number and submitting a quote or contact request, you acknowledge that your inquiry constitutes an established business relationship and that your consent to be contacted supersedes any registration on a state or federal Do Not Call registry for the purposes of communications related to your inquiry.

9. California Privacy Rights (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you specific rights regarding your personal information.

9.1 Your Rights

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collection, and the categories of third parties with whom we share it;
  • Right to Delete: You have the right to request deletion of personal information we have collected, subject to certain exceptions;
  • Right to Correct: You have the right to request correction of inaccurate personal information;
  • Right to Opt-Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information. To exercise this right, contact us at support@coveredamerica.org with the subject line "California Opt-Out Request";
  • Right to Limit Use of Sensitive Personal Information: You have the right to limit our use of sensitive personal information (including health data and income information) to uses necessary to provide our services;
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

9.2 Exercising Your Rights

We will respond to verifiable requests within 45 days. We may extend this period by an additional 45 days when reasonably necessary, provided we give notice of the extension within the initial 45-day period.

10. Health Information & HIPAA Notice

Covered America LLC is an insurance agency, not a healthcare provider or health plan. As such, we are generally not a "covered entity" under the Health Insurance Portability and Accountability Act (HIPAA). However, we treat all health-related information you provide with the highest level of care and confidentiality.

Health information you provide — including medical conditions, prescription drug use, household member health status, and income — is used solely for the purpose of providing insurance plan comparisons and enrollment assistance. This information is shared only with licensed insurance carriers and agents as necessary to fulfill your request.

We maintain appropriate administrative, technical, and physical safeguards to protect the confidentiality and security of health information you provide. We do not sell or rent health information to third parties for independent marketing purposes.

If you have questions about how a specific insurance carrier handles your protected health information after enrollment, please refer to that carrier's HIPAA Notice of Privacy Practices, which will be provided to you at the time of enrollment.

11. Insurance Disclaimers

11.1 Licensing

Covered America LLC operates as a licensed insurance agency. Agents affiliated with Covered America are licensed in the states in which they operate. Licensure information is available upon request. Contact us at support@coveredamerica.org for state-specific licensing details.

11.2 ACA / Marketplace Disclaimer

Covered America assists individuals in enrolling in health insurance plans available through the Affordable Care Act (ACA) federal and state Marketplaces, as well as off-Marketplace private health plans. Covered America is not affiliated with HealthCare.gov, any state-based exchange, or any government entity. Advance Premium Tax Credit (APTC) and cost-sharing reduction estimates are based on information provided by the applicant and are not guaranteed. Actual subsidy eligibility is determined by the federal Marketplace (HealthCare.gov) or applicable state exchange at the time of enrollment.

11.3 Medicare Disclaimer

Covered America is not connected with or endorsed by the U.S. Government or the federal Medicare program. We do not offer Medicare Supplement, Medicare Advantage, or Part D plans through this Site. If a licensed agent contacts you regarding Medicare products, that agent is independently licensed and their communications are governed by applicable CMS marketing guidelines.

11.4 No Advice of Counsel

Nothing on this Site constitutes legal, tax, or financial advice. Insurance decisions have legal and financial implications. You are encouraged to consult with a qualified attorney, tax advisor, or financial planner before making coverage decisions.

11.5 Premium & Benefit Accuracy

Plan premiums, deductibles, out-of-pocket maximums, and benefit details displayed on this Site are sourced from the CMS Marketplace API and carrier data feeds. This information is updated regularly but may not reflect mid-year carrier updates, corrections, or state-specific variations. Always verify plan details directly with the insurance carrier before enrolling.

11.6 Provider & Drug Network Accuracy

Provider network and drug formulary data is sourced from carrier-submitted data and the CMS Marketplace API. Network accuracy depends on the timeliness and accuracy of carrier-submitted information. Always confirm that your providers and medications are covered under any plan you select by contacting the carrier directly before enrolling.

11.7 No Guarantee of Enrollment

Submitting an application through or with the assistance of Covered America does not guarantee enrollment in any insurance plan. Enrollment is subject to carrier acceptance, Marketplace verification, eligibility determination, and applicable enrollment period rules. Special Enrollment Period (SEP) eligibility is determined by the federal or state Marketplace and is not guaranteed by Covered America.

11.8 Compensation Disclosure

Covered America and its licensed agents are compensated through commissions paid by insurance carriers. This compensation does not increase the premium you pay. Our agents are not paid more to recommend one carrier or plan over another. Our obligation is to assist you in finding a plan that meets your needs.

12. Limitation of Liability & Indemnification

12.1 Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND INFORMATION PROVIDED HEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. COVERED AMERICA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COVERED AMERICA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF COVERED AMERICA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL COVERED AMERICA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO COVERED AMERICA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

12.3 Indemnification

You agree to defend, indemnify, and hold harmless Covered America LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of this Agreement; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your submitted information caused damage to a third party.

12.4 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida for any legal proceedings arising out of or relating to this Agreement.

13. Dispute Resolution & Arbitration

13.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact Covered America at support@coveredamerica.org and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving notice.

13.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Covered America agree to resolve any dispute, claim, or controversy arising out of or relating to this Agreement or the Site through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Broward County, Florida, or by telephone if agreed by the parties.

13.3 Class Action Waiver

YOU AND COVERED AMERICA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

13.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

13.5 Severability

If any provision of this Agreement is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect any other provision of this Agreement.

14. CMS Agent-Assisted Enrollment & Consumer Consent

Pursuant to 45 C.F.R. § 155.220(j)(2) and the ACA Marketplace Privacy & Security Requirements

This section governs the agent-assisted enrollment services provided by Covered America LLC through CoveredAmerica.org. By submitting an application through this Site, you are granting Covered America LLC explicit authorization to complete and submit your Marketplace enrollment on your behalf.

Federal regulations under the Affordable Care Act (45 C.F.R. § 155.220(j)(2)(iii)) require that licensed agents, brokers, and web-brokers obtain and document your written or electronic consent before they may search the Marketplace for your existing application, collect your personally identifiable information (PII), complete or update a Marketplace eligibility application on your behalf, or enroll you in a Qualified Health Plan (QHP). Covered America LLC collects this consent through a mandatory, four-part consent step at the beginning of the enrollment application on this Site. By checking the Agent Authorization & PII Consent box, you authorize Covered America LLC and its licensed agents to search the Federally-facilitated Marketplace (FFM) or applicable State-Based Marketplace (SBM) on your behalf; create, collect, view, use, disclose, access, maintain, and store your PII solely for enrollment purposes; complete and submit your eligibility application for a Qualified Health Plan (QHP); apply for Advance Premium Tax Credits (APTC) and Cost-Sharing Reductions (CSRs) on your behalf; provide ongoing account maintenance, plan renewals, and enrollment assistance; and respond to Marketplace inquiries regarding your application. Your PII will not be used for any purpose other than those listed above without your additional explicit consent.

Your consent is granted to Covered America LLC as an agency, including its Principal Broker Joseph Valle (NPN: 20970762) and any licensed agent or broker acting under the supervision and authority of Covered America LLC. Licensed agents within our agency who are assisting with your application may rely on your consent without requiring you to re-authorize each individual agent. CMS guidance permits this agency-wide consent where the documentation names the agency and identifies the agents authorized to act on its behalf.

Your consent remains in effect for the current plan year and carries over to any subsequent plan year renewal, unless you revoke it sooner. You may revoke or modify your consent at any time by emailing support@coveredamerica.org with the subject line "Consent Revocation Request," by calling (888) 708-9396 (Mon–Fri 8am–8pm, Sat 9am–5pm EST), or by writing to Covered America LLC, 1314 E Las Olas Blvd #2371, Fort Lauderdale, FL 33301. Revocation takes effect upon our receipt and confirmation and does not affect any enrollment actions already taken in reliance on your consent. After revocation, Covered America LLC will not make further changes to your Marketplace application without obtaining new consent. Covered America LLC retains your consent documentation for a minimum of 10 years from the date consent was given and will produce such documentation to CMS upon request in connection with monitoring, audit, or enforcement activities, as required by 45 C.F.R. § 155.220(j)(2)(iii)(C).

Before your application is submitted to the Marketplace, you are required — and by using this Site you confirm — that you have reviewed all application information for accuracy, including household member details, income, residency, and Special Enrollment Period qualifying events, as mandated by 45 C.F.R. § 155.220(j)(2)(ii)(A). Covered America LLC will not submit your application without first obtaining your confirmation that the information is accurate. Submitting false, inaccurate, or misleading information on a Marketplace application may result in loss of coverage eligibility, required repayment of advance premium tax credits, civil monetary penalties, or other consequences under federal law (26 U.S.C. § 36B; 45 C.F.R. Part 155).

Covered America LLC is required by CMS (45 C.F.R. § 155.260) to display a Privacy Notice Statement wherever PII is collected. Your personally identifiable information is collected solely to assist with Marketplace eligibility and enrollment, is protected under applicable federal privacy and security standards, and is not sold to third parties. You are not required to share any PII beyond what is needed for your Marketplace application. When you submit an application through CoveredAmerica.org, your information is securely transmitted to a licensed agent who reviews it and may contact you to confirm details or discuss plan options. With your authorization, the agent then accesses the Federally-facilitated Marketplace using HealthSherpa (an HHS-approved Enhanced Direct Enrollment partner) or another approved platform, completes and submits your eligibility application using the information you provided and confirmed, and you receive enrollment confirmation directly from the Marketplace and/or the insurance carrier. Covered America LLC may use HealthSherpa or other CMS-approved Enhanced Direct Enrollment (EDE) or Classic Direct Enrollment platforms certified by HHS to process your application. Your National Producer Number (NPN) on file with the Marketplace will reflect your assigned agent at Covered America LLC.

As an enrollee, you retain the right to contact the Marketplace directly at any time at HealthCare.gov or by calling 1-800-318-2596, to request a different agent or broker, to revoke agent authorization at any time as described above, to review your consent documentation upon request, and to submit a complaint regarding agent conduct to your state Department of Insurance or to CMS at marketplace.cms.gov.
